Acceptance.
Use of our tacúText service is subject to your compliance with our
terms and conditions, which constitute a legal agreement between you
and Reddar Ltd. Each time you use tacúText you signify that you have
read, understood and agree to be bound by the Terms of Service. USE OF
THIS WEBSITE AND ANY MOBILE PHONE FUNCTIONALITY SIGNIFIES THE
ACCEPTANCE OF THE TERMS OF SERVICE AGREEMENT AND THE PRIVACY POLICY. If
you do not agree with the terms of either of these documents, please do
not provide us with any information and do not use Reddar services such
as tacúText or this Web site.
Jurisdiction
tacúText is a simple low-cost group communications service using low
cost premium texts to spread the cost fairly between the group creator
and the group members.
Since
premium texts may not work outside the country they are registered in
(roaming) Reddar limited makes no representation or warranty that our
service tacúText or information on our website is applicable or
appropriate for use outside Ireland.
Your
access to our tacúText service and our website as well as the terms and
conditions and the agreement they create are governed and interpreted
by the laws of Republic of Ireland only, without regard for conflict of
laws provisions.
Basic Terms
You
cannot use the tacúText to publish, post, distribute, or disseminate
defamatory, infringing, obscene, or other unlawful material or
information.
Do not post messages
that contain material protected by intellectual property laws, rights
of privacy or publicity or any other applicable law unless you own or
control the rights thereto or have received all necessary consents.
Reddar is not responsible for any use of anything you say or post.
Do not post messages that may be considered to be vulgar, political, or offensive to any other users.
Availability
Reddar uses all reasonable efforts to ensure that our services are
available 24 hours a day, 7 days a week. However, there will be
occasions when the service will be interrupted for maintenance,
upgrades and emergency repairs or due to failure of telecommunications
links and equipment that are beyond our control. Every reasonable step
will be taken by us to minimise such disruption where it is within the
reasonable control of Reddar.
Since
we depend on third party mobile telecommunications providers to deliver
messages to tacúText service users over mobile wireless links we can
not guarantee successful message delivery. However the Short Message
Service is generally reliable and mobile telephone operators try to
deliver messages repeatedly over a period of several days.
Premium
texts cost money to receive so you will not receive them if your
telephone account is blocked or, if you are a pay-as-you-go customer,
your account is out of credit.
We reserve the right to delete tacúText groups that are unused (no messages posted) for over six months.
Right of Termination
Reddar Ltd. reserves the right, at its sole discretion, immediately,
without notice to you to restrict, suspend or terminate
(i) these Terms of Service;
(ii) your registration with or ability to access tacúText and/or any
other service provided to upon any breach, or suspected breach by you
of the Terms and Conditions (as determined in Reddar’s sole
discretion). The restriction, suspension or termination of our service
pursuant to this section will be without prejudice to any rights which
Reddar may have against you in respect of your breach of these Terms of
Service.
Disclaimer of Warranties
This website and messages from our tacúText service may
contain errors and inaccuracies. Changes to the website and our
tacúText service are made periodically and without notice. Your use of
the tacúText service and our website is at your risk. Neither Reddar
Ltd or any of its affiliates will be liable for any damages including
direct, indirect, incidental, consequential or punitive damages,
arising out of your access to or use of the Website(s) or our tacúText
service. Without limiting the foregoing, everything in our service and
website is provided to you as is without warranty of any kind either
expressed or implied, including but not limited to the implied
warranties of merchantability, fitness for a particular purpose or
title and non-infringement. Additionally, Reddar does not warrant that
tacúText service or website(s) or the servers making the site(s)
available are virus free.
